1) Scope

1.1 These General Terms and Conditions (hereinafter "GTC") of Redoine Hamarlain, trading as "Dropsirius" (hereinafter "Seller"), apply to all contracts for the delivery of goods concluded between a consumer or entrepreneur (hereinafter “Customer”) and the Seller regarding the goods displayed in the Seller’s online shop. The inclusion of the Customer’s own terms and conditions is hereby excluded unless otherwise agreed.

1.2 A consumer, according to these GTC, is any natural person who enters into a legal transaction for purposes that are predominantly not related to their commercial or self-employed professional activity.

1.3 An entrepreneur, according to these GTC, is a natural or legal person or a legal partnership that acts in the exercise of their commercial or self-employed professional activity when concluding a legal transaction.


2) Conclusion of Contract

2.1 The product descriptions in the Seller’s online shop do not constitute binding offers but serve for the Customer to submit a binding offer.

2.2 The Customer can submit an offer via the online order form in the Seller’s shop. By completing the electronic ordering process and clicking the button to finalize the order, the Customer submits a legally binding offer regarding the goods in the shopping cart.

2.3 The Seller may accept the Customer’s offer within five days:

  • by sending a written order confirmation or confirmation in text form (fax or email), the receipt of which by the Customer is decisive, or

  • by delivering the ordered goods, the receipt of which by the Customer is decisive, or

  • by requesting payment from the Customer after order submission.

If multiple alternatives apply, the contract is concluded at the moment the first alternative occurs. The acceptance period starts the day after the Customer submits the offer and ends on the fifth day. Failure to accept within this period is considered a rejection, and the Customer is no longer bound by their offer.

2.4 The contract text is stored by the Seller after submission and sent to the Customer in text form (e.g., email). If the Customer created an account before submitting the order, the order data is stored and can be accessed via their password-protected account.

2.5 Before submitting the order, the Customer can check for input errors on the screen. A useful tool is the browser’s zoom function. Input errors can be corrected until the final submission button is clicked.

2.6 The contract is concluded exclusively in German.

2.7 Order processing and contact usually occur via email and automated order handling. The Customer must ensure their email address is correct to receive emails, including those from spam filters.


3) Right of Withdrawal

3.1 Consumers generally have a right of withdrawal.
3.2 Detailed information is provided in the Seller’s cancellation policy.
3.3 The right does not apply to consumers who, at the time of contract conclusion, are not in an EU member state and whose sole residence and delivery address are outside the EU.


4) Prices and Payment Terms

4.1 Unless stated otherwise, prices are total prices. VAT is not shown, as the Seller is a small business under the German VAT Act (UStG). Additional delivery and shipping costs are listed separately in the product description.

4.2 For deliveries outside the EU, additional costs may occur (e.g., bank fees, import duties), which the Customer must bear.

4.3 Payment methods are indicated in the online shop.

4.4 For advance payment via bank transfer, payment is due immediately unless otherwise agreed.

4.5 Payments via “SOFORT” are processed by SOFORT GmbH, Munich. The Customer must have an enabled online banking account and confirm the payment. Details: https://www.klarna.com/sofort/

4.6 Payments via credit card are processed through Stripe Payments Europe Ltd., Dublin. Stripe may conduct a credit check and reject payment if necessary.

4.7 Payments via Klarna are processed through Klarna Bank AB, Sweden. Details: https://dropsirius.com/pages/zahlungsarten


5) Delivery and Shipping Conditions

5.1 Delivery is made to the address provided by the Customer within the specified delivery area.

5.2 If delivery fails due to reasons attributable to the Customer, the Customer bears reasonable costs. This does not apply if the Customer validly exercises their right of withdrawal.

5.3 For entrepreneurs, the risk passes to the Customer upon handover to the carrier. For consumers, the risk generally passes upon delivery to the Customer, unless the Customer instructs the carrier themselves without prior notice from the Seller.

5.4 The Seller reserves the right to withdraw from the contract in case of incorrect or improper self-supply, provided the Seller is not at fault. The Customer will be informed, and payments will be refunded promptly.

5.5 Self-collection is not possible.


6) Retention of Title

The Seller retains ownership of the goods until full payment of the purchase price.


7) Liability for Defects (Warranty)

7.1 Unless otherwise stated, statutory warranty provisions apply.

7.2 For entrepreneurs:

  • The Seller chooses the type of remedy.

  • For new goods, the limitation period is one year from delivery.

  • Rights for used goods are excluded.

  • Limitation does not restart with replacement delivery.

7.3 Exceptions to limitations:

  • Claims for damages,

  • Fraudulent concealment of defects,

  • Goods incorporated into buildings causing defects,

  • Obligations to provide updates for digital products.

7.4 Legal recourse periods remain unaffected.

7.5 For merchants (§1 HGB), inspection and complaint duties apply. Failure does not affect legal claims.

7.6 Consumers should report visible transport damage to the carrier and notify the Seller; failure does not affect legal claims.


8) Applicable Law

8.1 German law applies, excluding international sale of goods laws. For consumers, this applies only if mandatory protection under their country’s law is not removed.

8.2 This does not affect statutory withdrawal rights for consumers outside the EU.


9) Alternative Dispute Resolution

9.1 The EU Commission provides an online platform for dispute resolution: https://ec.europa.eu/consumers/odr

9.2 The Seller is neither obliged nor willing to participate in proceedings before a consumer arbitration board.
